Are Oral Releases Enforced by the Court?

Unfortunately, these oral releases are enforced by our Texas courts. In short, if you are involved in a wreck, the other party’s insurance company may contact you. They will promise you some money in exchange for your oral agreement to release their insured. The call will likely be recorded without your knowledge, which is illegal.

If you find out later that your injuries are more severe than you thought, then you will have accepted compensation that is inadequate. The compensation may not even cover the costs of your injuries and/or property. At this point, it will probably be too late to reverse things.
